Class Action Lawsuits Related to Certain BMW and MINI Vehicles with Defective Sunroofs and Moonroofs
Kessler Topaz Meltzer & Check, LLP (“Kessler Topaz”) is presently litigating class action lawsuits against BMW of North America, LLC and Bayerische Motoren Werke Aktiengesellschaft (collectively “BMW”) on behalf of all persons in the United States who purchased, own, owned, lease or leased certain BMW or MINI vehicles containing a sunroof or moonroof. The first action was filed on July 27, 2018 in the United States District Court for the District of New Jersey and the second action was filed on December 4, 2019 in the United States District Court for the District of New Jersey. The complaints allege that the sunroofs and moonroofs are defective in design, manufacturing, materials and/or workmanship. Further, the complaints allege that despite BMW’s knowledge of the defect in the sunroofs, BMW never disclosed to owners or lessees that the defect exists or that drivers and occupants of the vehicles are at risk and that vehicles equipped with the sunroofs/moonroofs expose drivers and passengers to a risk of sudden explosion or shattering.
